Red Muldoon’s will provisions
The OutlawsRed Muldoon’s will provisions place the Diamond M Ranch and the rest of his estate under Kate Muldoon’s control while giving Max Landon a conditional future in the business. Their significance lies in the distinction between Max’s promised opportunity and Kate’s authority: the will does not make him an owner or require her to retain him as foreman.
Estate and Beneficiaries
The will identifies Patrick Muldoon, commonly known as Red Muldoon, as its maker and leaves his property, land, stock, and cash to his daughter, Kate Muldoon. The estate includes the ranch and savings, as well as money in a checking account intended to cover the Diamond M Ranch’s operating expenses. Max Landon had access to that account, so he knew its balance; Judge Bailey said he did not know the amount at that moment.
Max Landon’s Conditional Future
Alongside Kate’s inheritance, the will expresses Red Muldoon’s wish that Max continue as foreman under Kate’s employment and eventually become a full partner. That provision offers Max a possible advancement, but it does not grant him an immediate partnership or displace Kate’s control over whether to employ him. If Kate dies, the will instead directs the entire estate to Max, making her death the condition for his inheritance of the whole property.
Enforcement and Immediate Effect
Judge Bailey read the will and told Max that if Kate did not wish to employ him, he would have to leave the premises within twenty-four hours. Bailey also said Kate was legally and morally justified in refusing to keep him as foreman, citing his recent attempts to murder her. The reading therefore made the will’s practical hierarchy plain: Max’s future at the ranch depended on Kate’s decision, while his claim to the entire estate depended on her death.
